I see it as a factor of both the active party, the victim, their respective cultures, and the situation. If a lone man rapes a girl, then he risks becoming Broo. If a raiding party 'make sport' of some captives while on a raid, then IMO they would not, if it is seen as part of the prize for raiding one's neighbors. Remember that we take the crime much more seriously than our ancestors did, and even to this day there are accusations that the stuffy old judiciary think that the women generally had it coming. I find the idea thoroughly abhorrent and unjustifiable, but I try not to let that influence my role-playing.
