How about this :

Say the player has taken Close Combat at 6/14 and then takes [snatching victory from defeat] at 8/12. In combat, if you choose to switch to another ability in mid contest, you just roll against the new aboilioy's difficulty number, but keep the same status points. Thus if the characetr is losing and switches to using his [snatching victory from defeat] ability, he's actualy making it _more_ difficulty for him to win. Tough.

If he took it as another 6/14 ability, then there's still no advantage and the character has wasted some workds.

Alternatively youy could treat it as a modifier to the close combat ability. It modifier applies in fairly common circumstances, so the character gets a (+1/-1) modifier when he's losing (i.e. has fewer status points than his opponent. i.e. He gets +1 in the circumstance under which the bonus applies (he's losing) and -1 when it doesn't (i.e. he's winning). (!?)

Then again, what am I doing running a game for such a twit? :)
