In a sense. But I think the point that the character lost and therefore dies is a good one - I suppose it depends on whether both characters are viewpoint, or where only one is. If only the human is viewpoint (PC in the bush) then the contest was implicitly to "survive without getting poisoned and killed", which they failed. If the snake was the viwpoint character (say, a PC transfomred for assasination purposes) then the snake lost the "pison the human an get away" contest, too. the mutual death bit could arise from any decision arising from a tie requiring GM's judgement, such as a mutual failure where both combatants are PC's.

I would be inclined to give them a Relationship tor reflect that enmity, even if they did not know about it.
