Even coast-line ambushes will rarely occur under a mile or so. Now, a thick fog, or dead of night, or a river can provide "quick ambushes", but out on the sea you'll rarely stand so close to the shore that a boat can reach you in under 5 minutes. (There's sand bars, and rocks, and beaches, and other nasty-to-ships stuff waiting close inshore). Unless the target ship is in a lee shore in a gale and can't come about, it should be able to make the pirate pursue it, giving time to power up magic.
