When you narrate it, probably you discover that an ability or another is appropriate, probably more appropriate than just saying: I do this by spending an HP. Right?

If you still have HPs, you probably have other options or have had them before the FA. If you have run out of HPs, and you need a FA, why repeat: "you can't do any FA because you have no HP"?

I don't think it's unfair. I think it adds nothing to the rules as they are.
