I think the problem is that, having been taken outside the D&D 'kill anything that moves' mentallity, people are finding it hard placing their characters in terms of the morality of killing, and tend to shift all the way to the only legal system they really know - the modern one. You're not at war, but killing people is OK. As you say, not a 20thC concept. It creates a grey area where people are worried about straying.
