I think it would have to be done with the assumption that the PCs were almost always the instigators. Otherwise, it makes the problem it's trying to fix even worse - essentially, even if you do pass the roll, you're likely to fail, especially if the opponent's skill is high. Interestingly, this remains the case regardless of the non-instigating character's skill - though higher skill does reduce the *consequences* of defeat for the non-instigator.
Like David, I don't think this would work for most groups. Though, evidently, it does work for some, which is useful to know.
