Not sure without the rules handy, but:

Surely if you are the only one|side with APs left at the end of the contest you get your desired outcome. I.e. your opponent's desired outcome is irrelevant.

Applying that logic means that even if they changed their goal to "escape" just before losing, since my goal was still "kill 'em" they get killed.
